Overview
Welcome to TokushuKnife.eu. These Terms of Service govern your access to and use of TokushuKnife.eu and your purchase of products and services offered through the website.
TokushuKnife.eu is operated by Tokushu Knife Malta Limited, an independent company registered in Malta and responsible for the operation of the Tokushu Knife brand throughout Europe. When you purchase through TokushuKnife.eu, your contract is with Tokushu Knife Malta Limited.
In these Terms, the words “we”, “us”, and “our” refer to Tokushu Knife Malta Limited. The term “Services” refers collectively to TokushuKnife.eu and the information, content, features, tools, products, optional services, and customer support made available through the website.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
By accessing the Services, creating an account, placing an order, or purchasing a product or service, you agree to these Terms together with our Privacy Policy, Refund Policy, and Shipping Policy.
Please read these Terms carefully. Nothing in these Terms excludes or restricts any consumer right that cannot lawfully be excluded or restricted.
1. Consumer Scope
These Terms are intended to govern retail purchases made by consumers through TokushuKnife.eu.
Separate terms may apply to wholesale, trade, resale, commercial, or individually negotiated business transactions. Purchasing a knife for use in a professional kitchen does not, by itself, remove any consumer rights that apply to you under applicable law.
2. Eligibility and Accounts
You must be legally capable of entering into a binding contract and legally permitted to purchase, receive, possess, and use the products ordered in your jurisdiction.
Because our products include sharp kitchen knives and related tools, we may refuse or cancel an order where we reasonably believe that the purchaser is underage, legally restricted from purchasing the product, or attempting to purchase or use the product unlawfully.
You must provide accurate, current, and complete information when creating an account, placing an order, or communicating with us. This includes your name, contact details, billing information, delivery address, and payment information.
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. Please notify us promptly if you believe that your account has been accessed without authorisation.
3. Products and Craftsmanship
Tokushu Knife specialises in authentic Japanese kitchen knives, sharpening equipment, whetstones, cutting boards, accessories, and related culinary tools.
We make every reasonable effort to describe and display our products accurately. However, colours, finishes, dimensions, weights, blade profiles, grinds, handles, textures, markings, and other details may vary because of photography, lighting, screen settings, natural materials, handmade production methods, and normal differences between individual products.
Many products are handmade or hand-finished. Minor variations in blade finish, forging marks, polishing, engraving, kurouchi finish, Damascus pattern, handle grain, colour, fit, weight, geometry, and dimensions may be characteristic of the product and do not necessarily constitute a defect.
Natural materials may change in appearance over time. Carbon steel and some stainless-clad knives may develop a patina, darken, discolour, or rust if not cleaned and dried promptly. These characteristics are not necessarily defects.
Product specifications are approximate unless expressly stated otherwise. We may update product descriptions, specifications, prices, or availability when necessary, but changes will not affect an order already accepted except where required to correct an error or comply with law.
4. Knife Safety and Intended Use
Kitchen knives and cutting tools are sharp and can cause serious injury if handled, stored, cleaned, sharpened, or used improperly.
You are responsible for using purchased products safely, lawfully, and in accordance with their intended culinary purpose. Knives should be stored securely and kept away from children and anyone unable to handle them safely.
Japanese kitchen knives may be harder, thinner, and more specialised than mass-market knives. Unless a product is specifically designed for such use, it should not be used to cut frozen food, bones, hard pits, shells, wire, packaging, or other inappropriate materials.
Do not use kitchen knives on glass, ceramic, stone, metal, or similarly hard cutting surfaces. Twisting, prying, striking, scraping, lateral pressure, and improper sharpening may chip, bend, crack, or otherwise damage a blade.
Product-care guidance is general information. You remain responsible for deciding whether a product is suitable for your intended purpose and for using it safely.
5. Orders and Contract Formation
Submitting an order constitutes an offer to purchase the products and services shown in your order.
Receipt of an automated order confirmation does not necessarily mean that we have accepted the order. A contract is formed when we accept the order, normally by confirming that it is being processed or dispatched.
We may refuse, limit, or cancel an order for a legitimate reason, including:
- the product being unavailable;
- a pricing, stock, description, or technical error;
- payment failure or payment-verification concerns;
- suspected fraud or unauthorised payment activity;
- shipping or legal restrictions;
- suspected unlawful purchase, resale, export, or use;
- an inability to complete requested custom work or services; or
- another circumstance that makes fulfilment unlawful or impracticable.
If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled product or order using the original payment method unless otherwise agreed.
Please review your order carefully before submitting it. You may request a cancellation or modification before fulfilment, but we cannot guarantee that changes can be made after preparation, custom work, packing, or dispatch has begun.
6. Pricing, VAT, and Payment
The price charged will be the price displayed at checkout when the order is placed, subject to correction of an obvious error.
Prices are displayed in the currency selected or shown at checkout. VAT treatment may depend on the delivery destination, customer location, and applicable tax rules.
Available delivery methods, shipping charges, discounts, and any applicable taxes or duties will be shown at checkout before payment is completed.
Where import duties or taxes apply, we use Delivery Duty Paid services so that applicable charges are handled in advance. Further information is provided in our Shipping Policy.
You confirm that you are authorised to use the payment method supplied and that the billing and payment information you provide is accurate.
We may use third-party payment providers to process transactions. We do not directly control the security, approval, or processing decisions made by your bank, card issuer, or payment provider.
7. Optional Services and Custom Work
Depending on the product and availability, we may offer optional services including:
- custom handle making;
- saya making;
- handle installation;
- sharpening before dispatch; and
- choil and spine polishing on eligible knives.
Availability, pricing, specifications, and preparation times may vary. Some services may require consultation or approval before work begins.
Custom handles and sayas are made or adapted to the customer’s specifications. Natural materials may vary in grain, colour, figure, texture, and appearance. Minor handmade variation is normal.
Handle installation, sharpening, and choil or spine polishing involve physical work being performed on a product. These services may alter the product from its original factory condition.
Please review and confirm all relevant choices before authorising custom work or a service. We are not responsible for preferences that were communicated incorrectly or incompletely by the customer, although this does not affect your rights where we fail to perform the agreed work with reasonable care and skill.
Where you ask us to begin a separately purchased service during an applicable withdrawal period, we may ask for your express consent to begin the service. Where legally permitted, you may be responsible for the proportion of the service completed before you notified us of withdrawal.
Your statutory right of withdrawal may not apply to goods made to your specifications or clearly personalised, including a genuinely custom-made handle or saya. The application of any exemption will depend on the nature of the product or service and applicable law.
Ordinary sharpening, handle installation, or choil and spine polishing does not automatically remove every consumer right. However, completed work may affect the condition, value, or return eligibility of the product as explained in our Refund Policy and as permitted by law.
8. Shipping and Delivery
Orders are processed, dispatched, and delivered in accordance with our Shipping Policy.
Delivery estimates begin after dispatch and are not guaranteed delivery dates. Delays may occur because of carrier disruption, customs processing, weather, public holidays, remote delivery locations, security checks, incorrect address information, failed delivery attempts, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address, telephone number, and any necessary access instructions.
For consumer orders, responsibility for loss or damage remains with Tokushu Knife Malta Limited until you, or a person nominated by you other than the carrier, receives physical possession of the goods, unless applicable law provides otherwise.
Please inspect your order promptly after delivery and contact us if it is damaged, incomplete, incorrect, significantly delayed, or marked as delivered but not received.
9. Returns, Refunds, and Right of Withdrawal
Returns, refunds, cancellations, and the EU right of withdrawal are governed by our Refund Policy and applicable consumer law.
EU consumers purchasing online generally have the right to withdraw from the contract without giving a reason within 14 days after receiving the goods, subject to statutory exceptions.
To exercise the right of withdrawal, you must clearly notify us before the withdrawal period expires. You may submit a return request through account.tokushuknife.eu or contact us using the details at the end of these Terms.
You may inspect and handle goods only as reasonably necessary to determine their nature, characteristics, and functioning. You may be responsible for a reduction in value caused by handling beyond what would normally be permitted in a retail shop.
Statutory exemptions may apply to goods made to the customer’s specifications or clearly personalised. Nothing in these Terms limits your rights where goods or services are defective, damaged, incorrectly supplied, or otherwise not in conformity with the contract.
10. Product Conformity and Consumer Rights
Products must conform to the contract and meet the requirements imposed by applicable consumer law.
If a product is defective, damaged, incorrectly supplied, or otherwise not in conformity with the contract, please contact us promptly. Depending on the circumstances and applicable law, you may be entitled to repair, replacement, price reduction, refund, or another appropriate remedy.
Normal wear, expected patina, ordinary natural-material variation, or damage caused by misuse, neglect, unsuitable cutting surfaces, improper storage, corrosion, unauthorised modification, inappropriate sharpening, twisting, prying, impact, or use outside the product’s intended purpose may not constitute a lack of conformity.
Nothing in these Terms excludes or restricts any mandatory legal guarantee or statutory remedy available to consumers.
11. Intellectual Property
The Services and their content, including trademarks, trade names, logos, text, product descriptions, photographs, graphics, videos, designs, layouts, databases, and other materials, are owned by or licensed to Tokushu Knife Malta Limited or used with permission from relevant rights holders.
“Tokushu Knife” and related names, logos, designs, and brand assets may be owned by or licensed from affiliated or third-party rights holders. Nothing in these Terms transfers any intellectual-property right to you.
You may access and use the Services for personal, lawful, non-commercial purposes. Except where permitted by law or with prior written permission, you may not reproduce, republish, distribute, modify, sell, license, scrape, systematically extract, publicly display, transmit, or create derivative works from the Services or their content.
Third-party trademarks, names, product images, and other materials remain the property of their respective owners.
12. Reviews, Photographs, and Other User Content
If you voluntarily submit a review, photograph, comment, suggestion, or other content to us or through the Services, you confirm that you own or have permission to use and submit that content.
You grant Tokushu Knife Malta Limited a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt, translate, display, and distribute the submitted content for operating, improving, and promoting Tokushu Knife and the Services.
This licence does not transfer ownership of your content to us. Where required by law, we will respect applicable privacy, attribution, and withdrawal rights.
You must not submit content that is unlawful, misleading, defamatory, abusive, obscene, discriminatory, malicious, infringing, or harmful, or that contains malware or another technological threat.
We may moderate or remove user content where reasonably necessary to protect customers, third parties, the Services, or our legal rights.
13. Acceptable Website Use
You may use the Services only for lawful purposes. You must not:
- use the Services for fraud, unlawful activity, restricted exports, or prohibited transactions;
- misrepresent your identity or provide false information;
- interfere with the security, availability, or operation of the Services;
- introduce malware, harmful code, or another technological threat;
- attempt to gain unauthorised access to an account, system, or data;
- harvest personal information or send unsolicited commercial messages;
- infringe our rights or the rights of another person;
- circumvent security controls, access restrictions, CAPTCHAs, or technical protections;
- use automated systems to place fraudulent or abusive orders; or
- purchase products for an unlawful purpose or delivery to a prohibited person or destination.
We may restrict or suspend access where reasonably necessary to protect the Services, customers, third parties, or our legal rights.
14. Automated Tools and Agents
Automated tools, crawlers, bots, scrapers, software agents, and AI agents must comply with applicable law, these Terms, our technical instructions, and any access restrictions we implement.
Automated systems must not conceal their identity, imitate human behaviour to avoid detection, circumvent technical protections, overload the Services, collect personal information unlawfully, reproduce protected content without permission, or continue accessing the Services after access has been restricted.
Nothing in this section restricts lawful indexing by recognised search engines, accessibility tools, security research authorised by us, or other uses that cannot lawfully be prohibited.
15. Third-Party Services and Links
The Services may use or link to third-party providers, including Shopify, payment processors, delivery companies, review platforms, analytics services, social platforms, and other technology providers.
Third-party services may be governed by their own terms and privacy policies. We are not responsible for the independent content, availability, or practices of third-party websites or services, except where applicable law provides otherwise.
A link to a third-party website does not necessarily mean that we endorse every statement, product, or service made available through that website.
16. Relationship with Shopify
Shopify provides the ecommerce platform used to operate TokushuKnife.eu. Products and services purchased through the website are sold by Tokushu Knife Malta Limited, not Shopify.
Shopify is not the seller, contracting merchant, manufacturer, fulfilment provider, or customer-service provider for your order.
Shopify may process personal information and payment-related data as described in our Privacy Policy and Shopify’s own privacy notices.
17. Privacy
We process personal information in accordance with our Privacy Policy.
Please review that policy for information about the personal information we collect, how it is used, when it may be disclosed, international transfers, retention, cookies, and your legal rights.
18. Errors and Availability
We may correct typographical errors, inaccurate specifications, pricing errors, stock errors, or other mistakes appearing through the Services.
If an obvious pricing or product error affects an order, we will contact you where practical and may cancel the affected item or order where permitted by law. If payment has already been collected, we will refund the amount paid for the cancelled item or order.
Adding an item to a basket does not reserve it. Product availability remains subject to confirmation until the order is accepted.
19. Service Availability
We aim to keep the Services secure and available, but we do not guarantee uninterrupted or error-free access.
We may temporarily suspend or modify part of the Services for maintenance, security, legal compliance, technical changes, or circumstances outside our reasonable control.
This section does not affect our obligation to fulfil accepted orders or provide remedies required by applicable law.
20. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or a breach of mandatory consumer rights.
We are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or failure to exercise legally required care and skill.
We are not responsible for loss or damage that:
- was not reasonably foreseeable when the contract was formed;
- was caused by your misuse, negligence, unlawful conduct, or failure to follow reasonable product-care or safety instructions;
- resulted from inaccurate information supplied by you; or
- relates to business loss where you purchased solely as a consumer.
We do not exclude responsibility for products that are defective, incorrectly supplied, unsafe, or otherwise non-conforming where applicable law makes us responsible.
Your statutory rights are not affected.
21. Events Outside Our Reasonable Control
We will not be responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disaster, war, terrorism, civil unrest, labour disruption, carrier disruption, government action, border closure, epidemic, infrastructure failure, or widespread technology or communications failure.
If such an event affects an accepted order, we will take reasonable steps to minimise the effect, communicate with you where appropriate, and provide any remedy required by law.
22. Changes to the Services or These Terms
We may update these Terms to reflect changes in law, regulation, business operations, technology, security requirements, or the Services.
The current version will be published on this page with an updated revision date. Material changes will be communicated where required by law.
Changes will not retrospectively reduce rights attached to an order already accepted unless required by law or agreed with you.
23. Suspension and Termination
You may stop using the Services at any time.
We may suspend or terminate access to an account or feature where reasonably necessary because of a material breach of these Terms, fraud, unlawful activity, misuse, security risk, or harm to another person.
Suspension or termination of website access does not remove obligations relating to an existing order, outstanding payment, intellectual property, privacy, liability, or another provision intended to continue after termination.
24. Severability and Waiver
If a court or competent authority determines that part of these Terms is unlawful, invalid, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure or delay by us in exercising a right does not waive that right.
25. Entire Agreement
These Terms, together with the policies and order information incorporated by reference, form the agreement between you and Tokushu Knife Malta Limited regarding your use of the Services and purchases through TokushuKnife.eu.
Nothing in this section excludes representations or information that form part of the contract under mandatory consumer law.
26. Governing Law and Disputes
These Terms and purchases made through TokushuKnife.eu are governed by the laws of Malta.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections provided by the law of your habitual residence where those protections apply.
We encourage you to contact us first so that we can attempt to resolve any concern directly and fairly.
Nothing in these Terms prevents an EU consumer from bringing proceedings before a court with jurisdiction under applicable consumer law, including a competent court in the consumer’s country of residence where legally permitted.
